Was just assaulted at work. What are my options?  Reply with quote  

So there's this white dude at my work who says "nigger" too much.
Less than an hour ago, he said it again, when I was talking to fellow employees about Obama.
I got loud with him and called him a "Ignorant piece of shit".
He proceeded to follow me outside where I was throwing out some boxes.
And threatened me, I stared him down, and he grabbed me by the throat with both hands. It was broken up by fellow employees, and I reported the incident to the owner who stated: "I'll handle it, we don't need the aggravation"
I didn't call the police and file charges.

What are my options?

What industry do you work in?

In my uber-corporate world they don't take assault and racial slurs lightly.

if that dude wasn't fired on the spot I'd file charges. I might even file charges even if he was fired on the spot. That's bullshit.

call the police & make it legit. over aggressors are the worse type of people. dude needs to learn a lesson.

It's a seafood market. I work there with, (mostly) friends, to support my screen-printing business.
We do wholesale and retail.

What kind of time frame do I have to do this in?
I'd like to see how the owner handles this first.

Dude assaulted you. If you want to press charges, press charges. Otherwise, hopefully the owner/boss does the right thing (ie, after finding out what went down, firing the asshole).

He's not really worth revenge.

It'd be cool with me if he was fired.

I don't want to sue the company, but maybe the assailant?
Would it be a weak case if I said some things that he deserved to hear, but never physically touched him?

I'm just looking for options right now.

He didn't fire him while I was there, ie. not "on the spot".

It's been busy seeing as it's Lent, and shit was mad hectic there today.
I understand that.

This is also not the first time he's threatened me. Also before I left, dude threatened to fight me outside.

I hate even having to waste time on this guy...

IANAL, but I'd say you have a strong case, particularly if there were witnesses who will vouch that you were not the aggressor.

Normally, I'd say that calling him a piece of shit would count as "fighting words", legally basically excusing him for attacking you. But the n-word is also a "fighting word". So... I'd say he's still at fault.

Even if calling someone a piece of shit constitutes 'fighting words,' that doesn't excuse an assault. Fighting words just aren't protected speech and someone can be charged with 'breaching the public peace' or some such non-sense for saying them. But they don't open the speaker up to assault.

file charges, or make a report. that way when you go out to your car one day after work and your windows are smashed in and your tires are slashed you can have some support. that is if he did it and it wasn't your ex.

I don't know anything about the law, but if I were you, I'd report it ASAP. I think it would be better to report it and then decide not to press charges then to hold off on reporting it and not be able to press charges/have a weaker case because you waited so long.

Thats just me though, sorry you had to deal with that.
