freedom of speech violated?  Reply with quote  

can anyone offer me any suggestions other than to quit my job...i recently posted some pics of my work and people in it...anyway, a girl got offended that her ass was online, i told her sincerely that i would take it down but i forgot...anyway i got a call from my boss this morning threatening to fire me if i did not take down "all pictures concerning work"...i renamed the index and created another one...

am i protected at all under my "rights as an american" or quite simply am i fucked and have to quit my job before this page can be displayed as intended...

quite frankly i'm astounded, hurt, and very much angry

you should fight it all the way man.. but
make sure your within your rights because i have no idea about laws, and picture takeing involvieng work.. but if your in the right. tell them off if you feel its the right thing to do. also keep in mind that this could give your boss a reason to dislike you and even though he cant fire you, he may be able to cut your hours or give you shit and try and force you to quite... just think it out.

If you take a picture of someone without asking they have the rights to your film. If someone doesn't want their picture on the internet just take it down.

Dude if you seriously think it's a free speech issue that your boss is demanding you take a photo of your coworker's ass off the internet

then you are a depressingly self-absorbed and underinformed person.

Freedom of speech is about your GOVERNMENT not STIFLING you. It's not about humiliating your coworkers.

i read it thinking that it was a picture of your coworker turned around so that her ass was showing. not a direct picture of her ass. if thats the case, yah i agree with jesse.

Falls under a body of law called "expectation of privacy" You think papparazzi photographers get releases when they shoot a celebrity in public? No.

But keep in mind, laws don't neccesarily protect you from corporate policies, unless those policies run afoul of the law. It's very unlikely you would have strong enough grounds to win a civil suit either.

he's right...i have been self-absorbed about this and the ass pic was quite offensive...underinformed however i cannot agree with...i'm making this a bigger issue in my mind than it really is...solution: take the ass pic down and request permission of each person individually to put their pics up, no big deal...this isn't the huge/mind blowing issue i thought it was...thanx for setting me straight everyone...and for the critical feedback

notguilty: Intent can never define right and wrong. Judging by just reading what you said, it's clear your intentions weren't at ALL bad. You seem like the trickster type, and I'm the same way so that's fine.

However, if the girl got offended and didn't want her ass up there, the nice civil thing to do is apologize and take it down.

Since you're not using the images for commercial gain, and it's not pornography, legally, I believe you to be within your legal rights. It's just not exactly ethical.

Yeah but you don't have to break the law to be dismissed from your job with cause. It's not against the law to lean against a broom all day... and that's exactly the kind of behaviour that lost my my position as chief neurosurgeon at Victoria General Hospital!

Actually, Jesse, unless that type of behaviour is outlined in the code of conduct at his place of employment, they *couldn't* fire him. I don't know if it is, but even if it were he could make a freespeach issue out of it.

Most employers would've been like "Get that camera out of here." If no one told him not to take pictures, you must assume he didn't violate any kind of code of conduct.
