In early September of 2008, Jared Paul had the option to plead guilty and avoid this costly legal battle, but that didn’t jive with him and it didn’t jive with his supporters. On Feb 9th, at12:43 pm, our attorney informed us that the dismissal requests he filed to MN’s Ramsey Court were received and the case has been been dismissed without prejudice due to insufficient evidence. ALL CHARGES DROPPED.

On Sept 1, 2008 I received a voicemail from Sean Daley (aka Slug of Atmosphere) informing me that my longtime friend, Jared Paul, was sitting in a Minnesota jail cell. This was the first day of the National Republican Convention, a 5 day event that Jared was covering for a Providence publication. I thought to myself “Well…that was quick.” And then the dark, disturbing feeling washed over me. Jared Paul is currently in a legal battle with the St. Paul, MN court system, along with hundreds of others who face trumped up charges thanks to the overzealous riot police at the Republican National Convention. Jared is one of many who does not have the appropriate funds to hire proper legal representation and the ACLU of Minnesota is so overwhelmed by the sheer volume of RNC arrest cases that they are unable to provide assistance. What Jared does have is massive support from music and poetry communities. As soon as news of his situation was made public people were in a frenzy asking how they could help out. When bail was granted, Slug graciously posted the fee and waited the entire day and night for Jared’s release. I’ve agreed to front the remainder of Jared’s legal fees while creating www.ConspiracyToRiot.com as a way to raise awareness about his situation and accept donations for our cause. This has less to do with a friend of mine possibly looking at jail time, and more to do with citizen’s rights continually being trampled on. There are thousands of innocent people in jail right now because of their lack of finances. This is a principle thing as much as it is personal. Attorneys working with the National Lawyers Guild and the ACLU are identifying this year’s RNC as one of the most extreme examples of strategic, premeditated attacks on the First Amendment in U.S. history. The convention’s planning committee facilitated $50 million in Federal funds to the Ramsey County authorities, basically hiring out all local law enforcement available as the RNC’s own private military contract force. An additional $10 million was then spent on an insurance package to cover legal fees specifically resulting from police misconduct. Authorities used extreme force and mass arbitrary arrests to target, intimidate, and jail dozens of major and independent journalists all week long. Their tactics not only kept non-Convention citizens away from downtown but detainees were kept as long as legally possible, preventing journalists from reporting on any event outside of the Convention’s main itinerary.
DETAILS OF THE ARREST and UPDATES ON THE LEGAL CASE
On September 1st, 2008 Jared Paul (along with many others) was enjoying the music being performed at the “Take Back Labor Day” Festival in St. Paul when hundreds of Riot Police surrounded the park and arrested everyone on sight. Jared was charged with Felony-Riot and taken to Ramsey County Jail, where he would stay for next 3 days. During that time he was twice forced to strip naked before an armed guard, refused medical attention, physically threatened by correctional officers, and held on 23 hour a day cell confinement. Jared’s charge would later be reduced to a Gross-Misdemeanor, and then brought to Ramsey County Jail where he would not be released until the final day of the Convention.
Mass arrests continued for each following day of the convention, and by the end of the week over 800 people had been taken into custody by various RNC security forces. This includes more than 40 major news reporters, photographers, and staffers, and well over a hundred independent journalists, free-lance writers, and various other non-corporate media outlets from around the country. This was an extremely well organized, premeditated attempt to keep citizens off the street, detain them for as long as legally possible, and block any media presence from documenting the excessive force, blatant misconduct, and seemingly mandated use of clearly unconstitutional tactics employed all week long. This was a coordinated effort on behalf of several government agencies and it was executed with brutal efficiency.
Under Minnesota law “Gross Misdemeanor Riot” is punishable by up to 1 year in County Jail and/or $3,000 in fines. We’ve decided to fight this case with proper legal representation. A private attorney has been hired. A plea will NOT be copped and if necessary we will fight this to the very end. We don’t have $50 million to throw around like the RNC, but we we do have a community of people who are absolutely fed up with what has happened to this country. Enough is enough.
On September 30th, 2008 Jared had to travel from Providence to Minnesota for a 20 second pre-trial. The prosecutor offered a deal: “plea guilty to gross misdemeanor riot-3rd degree, and we’ll give you no jail time, there will be a fine and probation.”
We said no and the Judge ordered a Probable Cause hearing for October 21st. This is the hearing where we will try to prove that there was no cause for the arrest, and the prosecutor will try to prove otherwise. The truth is on our side. We have no idea what they have up their sleeves just yet.

I enjoy the new track, the beat is sick and the lyrics are sentimental and biting. It sort of seems like everything has lost meaning to a certain degree though. That isn’t to say, you becoming public and more in the “mainstream” is a bad thing but all the glitter and glamor seemingly dumbs down the message. If you want to say a lot, then say it and get it out there…but spare the public the act of changing the world one beat at a time. If Jared Paul was falsely arrested, which he more than certainly was, it proves that the situation he found himself in was unjust. Granted, don’t we already know that? If you’re going to picket a bunch of neo-cons who thrive on people’s frenzied disdain shouldn’t you expect, excuse my language, to be fucked with by a corrupt branch of an organization that is known for its distrust (government).
I’m honestly not trying to prove anything or discredit your work, or even demerit your lyrical honesty. I just don’t understand strong political overtones in music anymore. It used to be that all our old hardcore icons and legends had so much to say. Opposition then became a fad, counter-culture spawned and was commercialized by disingenuous organizations. I was there when Bush came to Canada a few years ago, and I saw another demonstrator get clubbed, cuffed and brought to his feet forcefully. What did he do you might ask? Nothing, he was in the front line but that was all. It wasn’t even 1 on 1, it was more like 3, or 5 on him.Soon after came the tear gas. Not to mention the RCMP taking photos of the protesters half the time. No, thats not censorship in the least.

We live in a sad world where things like the RNC and other protests get written off by all the mainstream media. I don’t think the average citizen realizes how important media reform is to changing this country.
It’s horrible that these things keep happening, Jared Paul getting arrested for no reason, but it’s a travesty that the media isn’t reporting on it. I know certain indy media outlets have, but unfortunately most people don’t watch, read or listen to such sources.

This RNC incident is much like last year’s incident in MacArthur Park in LA. a couple of years ago. Peaceful protesters were attacted by LAPD with non-lethal weapons (in their hands, if we had shot those same “non-lethal” weapons at them, It’ll be considered attempted murder). Keep the fight alive. Everyone must know of the police state in which they live! Democracy NOW!!!
yeah, too many type-o’s I noticed after i posted this comment. Sorry about that. MacArthur Park incident was a couple of years ago, and the people were ATTACKED, not attacted… Non-lethal weapons such as rubber bullets, tear gas, battons, boots, and badges!
I’m not saying that I am against this country, but honestly things have obviously gone down hill. I remember the peaceful and happy world I grew up in under Bill Clinton’s control. But now that I’m older, more involved, and experience poverty to an extent, I realize the true actions leading to such an unhappy world and life. It is sad and if I could help I would. But your friend committed no crime, nor did any of the others. I’m not going to protest anything, but I will pass this story along to everyone I can by word of mouth. Thanks for bringing attention to this aggregious assault on our civil liberties, and freedom of speech. I was right there where Jared got arrested, and it was the some of the scariest shit Ive seen. A lot of the backlash to the RNC police conduct has been muzzled , or distorted through the mainstream media, so keep pushing the truth!
I was arrested at the RNC as well and it’s great to see that you’re building support for those of us who didn’t have the opportunity to get a free lawyer. I was scooped up in the same mass arrest across the river from the SEIU event. The way people were being charged was so random, for example, reporters were arrested and charged with felony intent to incite riot…crazy shit. In any case, thanks for bringing relevance back to the term solidarity.
First of all, awesome song. I’ve always admired you and your music; I’ve been to one of your shows and you’re sensational. I started listening to you when Personal Journals first came out; one of my best friends told me to download “Inherited Scars” and after I did I was hooked. I then learned that you co-founded Knowmore.org, which I personally think is an awesome website. (I’ve enabled the Firefox extension and a couple of friends complimented it saying how cool it was.)
I started doing street activism in May and my first protest was at the Chevron refinery in Richmond, CA. I’ve been looking into the 9/11 “conspiracy” since high school (I personally hate that word), and have convinced myself that our own government has been and will continue to f*ck us over if we don’t do something about it. I feel that street activism is a great way to reach masses of people, and have reached out to a lot of people while on the streets handing out free pamphlets and documentaries.
There are so many things that I want to talk to you about, besides 9/11 of course, and I wish I could. I would like for you to take the time (when you can) to check out a couple of these websites and documentaries and maybe, possibly, watch these documentaries while you’re out on the road touring!
Keep doing what you’re doing, man. You are such an inspiration; I admire what you do and I admire what you jot down on paper. You’re waking people up, and it’s about damn time.

As a long time fan of your music who seems to have lost interest over the past few years (more me than you), I’m really glad to hear this song and the campaign you have going for your friend. I was in both Denver and St. Paul, and have since been giving a speaking tour with some of the people I’d traveled with around the western NY area to bring awareness to a lot of what you’re talking about in this song, and what the police repression flexed at these conventions means for resistance movements as a whole. So far, so good.

The first time i heard about Jared Paul was at the Raine Maida Concert in London Ontario Canada. I have been a fan ever since. I was shocked when I heard what is going on, completely outraged! He is an inspiration to many and I feel his voice is what this world needs to wake up and quit putting up with the shit we have stood by and let happen for way to long now. Man just eat that misdemeanor. Seriously, i know it goes against “the principle” but it doesnt mean your guilty and its better than wasting money feeding the lawyers, cops and court systems (read: oppressors) anyway. Im facing a couple felonies in some cases right now and im gonna hop all over a plea even when the principle is im not guilty of what im being accused of. This is all a ploy outta these institutions to make money, they dont give a shit about real crime. Just providing their own job security.

The phrase “mass arrest” appears in the main body of the Heffelfinger-Luger report 11 times. At the official presentation of the report at the St. Paul City Council on January 14th, the phrase was used hesitantly, almost reverentially as if to state the obvious would somehow have been the wrong thing to do.
